Terms of Service
Version 2026-07-23 · Effective on acceptance at signup or checkout.
These Terms govern your access to and use of the OmniaAuto API, hosted MCP server,
documentation, and data feeds (together, the “Service”). By requesting an
API key, completing checkout, or otherwise using the Service, you agree to these Terms. If
you are agreeing on behalf of a company, you represent that you may bind that company.
1. Accounts & API keys
- Your API key authenticates your account and is confidential. You are responsible for
all activity under your key. Keep it secret; do not embed it in public or client-side code.
- Notify support@omniaauto.ca immediately if a
key is exposed. We can rotate keys on request and may rotate or suspend a key we believe
is compromised or abused.
- One free key per email. Free-tier usage is subject to the published monthly call cap.
2. Plans & billing
All prices are in Canadian dollars (CAD) and billed through Stripe.
Billing terms differ by plan, so the terms for your plan are as follows:
- Free — no charge. Usage is capped at 1,000 API calls per calendar
month; there is no invoice.
- Metered (Pay-as-you-grow) — usage-based, not a fixed monthly
fee. You are charged CA$0.003 per API call, and your card is
billed automatically for each CA$150 of accrued usage (i.e. in
CA$150 billing blocks as you use the API). A per-customer monthly
spend cap (default CA$500) applies; contact us to adjust it.
- Feed — Province (CA$599/month) and Feed — Canada-wide
(CA$999/month) — flat recurring subscriptions, billed monthly in advance
until cancelled. See §3 for the IP-license conditions specific to Feed plans.
You can cancel anytime via the billing portal; access continues to the end of the paid
period. Fees already incurred (including metered usage) are non-refundable except where
required by law.
2a. Rate limits & fair use
Each plan has its own per-key rate limits and page-size limits. You must not attempt to
circumvent them, and you must honour 429 (rate limited) and 402
(quota / spend-cap) responses with appropriate backoff.
3. Feed license — locked to your server IP(s)
The Feed — Province and Feed — Canada-wide plans grant a
bulk export of the licensed dataset. Because they expose the full feed, they are licensed for
use only from the specific public IP address(es) you register at checkout
(your own server[s]):
- Your Feed key is pinned to those IP(s). Requests from any other address
are rejected (
403 ip_not_allowed) on both the REST API and the MCP server.
- To add, change, or remove a registered IP, email
support@omniaauto.ca from your account email.
You may register a reasonable number of IPs/CIDR ranges for your own infrastructure.
- The Feed license is for your organization’s own internal use. You may
not share your key, proxy the Service for third parties, or use the
registered IPs on behalf of another party.
4. Acceptable use
You agree not to:
- Redistribute, resell, sublicense, or publicly republish the data, or
build a competing listings dataset or bulk data product from it, without a separate written
agreement.
- Exceed your plan by scraping, offset-walking, key-sharing, running multiple keys to defeat
limits, or otherwise mirroring the dataset outside the licensed Feed.
- Attempt to re-identify individuals, or use the data in violation of privacy, consumer-
protection, anti-spam, or other applicable Canadian or local law.
- Probe, disrupt, or overload the Service, its rate limiting, or its infrastructure; or
access it other than through the documented interfaces.
- Use the data to contact, harass, or market to dealers or individuals in violation of law
(including CASL).
5. Data, accuracy & attribution
- Listings are aggregated from public sources and are provided “as is.”
We refresh continuously and target 24–48h freshness but do not warrant accuracy,
completeness, availability, or fitness for a particular purpose.
- The Service excludes non-originating (cross-listed) duplicates and is not a system of
record. Verify critical figures (e.g. price, VIN) at the source before relying on them.
- You retain no ownership of the data; your rights are limited to the license in these Terms.
6. Suspension & termination
We may suspend or terminate access for breach of these Terms (including acceptable-use or
Feed-license violations), non-payment, or suspected abuse or compromise, with notice where
practicable. On termination your license ends and you must stop using and delete cached data,
except data you are legally required to retain.
7. Liability
To the maximum extent permitted by law, the Service is provided without warranties, and
OmniaAuto is not liable for indirect, incidental, or consequential damages, or for lost profits
or data. Our total liability for any claim is limited to the fees you paid for the Service in the
three (3) months before the claim.
8. Changes
We may update these Terms; the version and effective date above will change and material
changes will be communicated by email or on this page. Continued use after an update constitutes
acceptance. These Terms are governed by the laws of the Province of Alberta and the federal laws
of Canada applicable therein.
